How will the Florida court determine where my children should reside after the divorce?
The court will use the Florida statutes and we’ll use 20 different factors to determine where the child will live after the divorce. It’s really important if you have a chance to make that decisions with your former spouse, chances are you know your child better. You know your child’s life better. If you can make that decision it’s better for you to agree then for two people to come into court debating where the child should go because judges have a very limited picture of this child’s life and judges do not like to make that decision. Everyone has to go to mediation at some point. You really have to discuss it with your former spouse to meet the best interests of the child.
