What is Domestic Violence?

According to Florida statute 741.28, domestic violence is defined as “any criminal offense resulting in physical injury or death of one family or household member by another family or household member,” and all of the following are considered acts of domestic violence:

  • Assault;
  • Aggravated assault;
  • Battery;
  • Aggravated battery;
  • Sexual assault;
  • Sexual battery;
  • Stalking;
  • Aggravated stalking;
  • Kidnapping; or
  • False imprisonment.

Domestic violence does not only happen when a man beats up a girlfriend or wife. In fact, when any family or household member commits a violent act against another household or family member, domestic violence has occurred. Family or household members include:

  • Spouses;
  • Former spouses;
  • Those who are related by blood or marriage;
  • Those who are currently residing together as a family or those who have resided as a family in the past; and
  • Parents of a common child, regardless of current or past marriage.

In order to qualify as a family or household member, the parties must currently be, or have been in the past, residing in the same home, except for two people who have a child together.
