Aubrey Ducker has received a Certficate of Appreciation from the Legal Aid Society of the Orange County Bar Association. The accompanying commendation letter reads, in part, "The Board of Trustees of the Legal Aid Society met and a resolution was approved acknowledging your exceptional efforts on behalf of Legal Aid clients . . . I am happy to present to you a Certificate of Appreciation in recognition of your work and to extend to you the thanks of the Trustees and staff of Legal Aid. Your time and service to assist the indigent of Orange County is a credit to the legal profession, but above all an indication of your commitment to public service." Congratulations, Aubrey!

We bid a fond farewell to two of our own. Kristie Haynes is heading on to the Law Office of K. Hunter Goff, P.A., to make the most of her bankruptcy law skills and Laura Lea Koger is joining the firm of N. Diane Holmes, P.A., as Firm Administrator. We wish them both the best of luck in their new endeavors.

We also welcome Robert Eckrich, who will be providing legal support and notarial services. Welcome, Bob!

Governor Charlie Crist yesterday signed Executive Order 08-211 enacting Florida's Silver Alert, which allows the immediate broadcast of information to the public regarding missing elders with dementia or other cognitive impairment. The Executive Order provides a coordinated response between local and state law enforcement to broadcast important information quickly to citizens so they can assist local law enforcement in the rescue of the endangered person and notify law enforcement with helpful information.

Congratulations to our Law Clerk, Kristie L. Haynes, on passing the Florida Bar Examination! Ms. Haynes is a 2008 graduate of the Dwayne O. Andreas School of Law at Barry University. We are certain that she will be a great asset to the legal profession.

Ms. Haynes looks forward to working on family law issues, particularly representing the best interests of children in divorce, custody, and guardianship matters.

We are pleased to learn that Aubrey Ducker has received a BV Peer Review Rating from Martindale-Hubbell. The BV Rating is the highest rating for ethics and legal ability available to an attorney practicing for 5 to 9 years.

Legislative Update

The Florida Bar Family Law Section will be encouraging the Florida Legislature to address at least some of the following in the upcoming session:

  • Specify whether both parents require court permission to relocate his or her residence.
  • Clarify the definition of "parenting plan recommendation" to allow Guardians Ad Litem and any person authorized to perform social investigations to make a parenting plan recommendation and require the parenting plan to list the address to be used when registering the children for school.
  • Child support: remove the 25% reduction in child care costs when calculating child support; impute minimum wage and other standards for imputation of income; terminate child support as children reach the age of majority; allocate support per child so that new support is readily ascertainable when one reaches the age of majority; eliminate guidelines for income below the poverty level.
  • Address security and/or interest when equitable distribution payment cannot be paid in a lump sum.
