Adult Guardianships and Conservatorships

Helping Incapacitated Clients

At THE LAW OFFICES OF AUBREY HARRY DUCKER JR., P.L.C., we have helped numerous clients who can no longer manage their daily lives. These clients, also called "wards," are tended or taken care of by an appointed guardian or conservator who makes decisions in terms of the ward's living arrangements, medical and financial needs and any other related needs or tasks.

The guardian or conservator determines a plan to assure that the client receives the highest quality of care possible.

In situations where the client is unable to conduct his or her own business, and has not appointed a guardian to handle his or her finances and health care decisions, we provide court-ordered authority for determining a guardian or conservator for the client. In most cases, the financial aspects are separated from the medical and personal decisions, sometimes requiring two separate decision makers or guardians. Conservatorships and Guardianships

Typically, conservatorships or guardianships are established for clients in comas or with a form of dementia, Alzheimer's, or another serious illness. At THE LAW OFFICES OF AUBREY HARRY DUCKER JR., P.L.C., we have experience determining the appropriate form of guardianship or conservatorship for our clients.

Conservators are oftentimes determined to handle client's financial or estate matters, such as estate planning, trusts and wills. Clients under the age of 18, who are receiving an inheritance or settlement, are also placed under the care of a conservator. Guardianships for children in many circumstances are necessary and can be both complex and time consuming. We make the process work for you to allow you to focus on the child.

Adult guardians tend to the client's daily needs and tasks, such as personal hygiene, clothing, food shopping and other related tasks. Adult guardians may be family members, neighbors, or professionals who are paid for services rendered on behalf of the ward. Guardianships are complex legal proceedings requiring an attorney to represent the proposed guardian at every step of the process.
